BREAK-AWAY TOURS TERMS AND CONDITIONS

IMPORTANT – THESE TERMS AND CONDITIONS ("TERMS") APPLY TO ALL GUESTS PARTICIPATING ON A TOUR OPERATED BY BREAK-AWAY TOURS. BY BOOKING A TOUR YOU AGREE TO BE BOUND BY THE TERMS SO PLEASE ENSURE THAT YOU READ THEM CAREFULLY.

These Terms apply to all tour members. By accepting these terms electronically via the online booking system or otherwise confirming your acceptance of them in writing, you agree to be bound by them. Please ensure you read them carefully and raise any questions you may have before you make your booking.

We utilize the services of Checkfront and Square regarding payment services via the Internet. You expressly agree to Checkfront and Square handling the payment transaction, your card details and any other information necessary for such payment transaction for the reservation of any tour operated by Break-Away Tours to be executed by Checkfront and Square (including, without limitation, fraud prevention). Square is certified by banks and card acquirers to securely manage payment transactions. All communication between the Break-Away Tours website and your bank is handled by Square and encrypted via SSL (Secure Sockets Layer).

1 INFORMATION ABOUT US AND HOW TO CONTACT US

1.1 We are Break-Away Tours. We partner with various regional theatre across the country to provide bespoke tours to some of the top theatre destinations in the word. Our office is located at 2535 Kettner Blvd. Suite 1B3, San Diego, CA, 92101

1.3 If we have to contact you, we will do so by telephone or by writing to you at the email or mailing address you provided to us at the time of booking.

2 OUR CONTRACT WITH YOU

2.1 Our acceptance of your booking will take place when we email you a booking confirmation, at which point a contract will come into existence between you and us. The terms of that contract are the Terms set out here together with the terms of your booking confirmation.

2.2 If we are unable to accept your booking, we will inform you of this and will not charge you for your specific theatre’s tour. This might be because the tour you have signed up for is unavailable, because we have identified an error in the price or description of the tour or because we are unable to meet your specified requirements.

2.3 We will assign a booking reference to your booking and tell you what that is when we send you your booking confirmation. It will help us if you can tell us that booking reference whenever you contact us about your booking.

2.4 These Terms apply solely for the provision of a tour operated by us in both the USA and in Europe.

3 TOURS

You must ensure that prior to attending or taking part in one of our tours, you have read carefully and can comply with the (i) pre-conditions and (ii) general terms set forth herein.

4 CHANGES TO BOOKINGS

If you wish to make a change to a booking you have made, please contact us. We will let you know if the change is possible and, if it is possible, we will let you know whether this causes any change to the price or timing of the tour or anything else which may be necessary as a result of your requested change and ask you to confirm whether you wish to proceed.

5 DELIVERY OF TOUR

5.1 We will provide the tour to you at the date and time and for the city specified in your booking confirmation.

6 YOUR RIGHTS TO CANCEL THE BOOKING

6.1 You may cancel the booking for any of the reasons set out below, and when you do so the contract between us will end immediately and we will refund you in full for the relevant tour:

(a) we have told you about an error in the price or description of the tour you have booked and you do not wish to proceed;

(b) we have suspended offering the tour for technical reasons or we notify you that we are going to suspend the tour.

7 REFUNDS

For all tours before June 1, 2023:

7.1a. If a participant has to cancel after partial or full payment has been made, the following cancellation schedule will apply: Full refunds will be made if written cancellation is received at least 90 days prior to departure. Cancellations received between 60-89 days prior to departure will be subject to a cancellation fee of $750. Cancellations received between 45-59 days prior to departure will be subject to a cancellation fee of $1,500. Cancellations received within 30-44 days prior to departure will be subject to a cancellation fee of $2,000 per person, plus any applicable airline ticket cancellation charges. Cancellations within 30 days, no refund.

For all tours after June 1, 2023: 

7.1b. If a participant has to cancel after partial or full payment has been made, the following cancellation schedule will apply: Full refunds will be made if written cancellation is received at least 120 days prior to departure. Cancellations received between 75-119 days prior to departure will be subject to a cancellation fee of $1,500 per person. Cancellations received between 45-74 days prior to departure will be subject to a cancellation fee of $2,500, plus any applicable airline ticket cancellation charges. Cancellations within 44 days, no refund.

8 OUR RIGHTS TO CANCEL THE BOOKING

8.1 We may cancel a booking at any time by writing to you if:

(a) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to make travel arrangements; or

(b) we are unable, for reasons beyond our control, to fulfil your booking and provide you with the relevant tour.

9 LIABILITY

9.1 The partnering regional theatre that you are associated with is acting solely as coordinator for this tour. All air and land arrangements are through Break-Away Tours. Your associated regional theatre is only the sponsor of the tour and shall not be liable or responsible in any way for loss, personal injury, or damage to, or in respect of, any person or property of those tour participants.

10 COVID-19 HEALTH & SAFETY PLEDGE

To help safeguard your health and wellbeing as well as that of your fellow tour members, BREAK-AWAY TOURS staff, and BREAK-AWAY TOURS tour partners, we are asking all tour members to agree to the conditions outlined in this COVID-19 Health and Safety Pledge.

☐ I agree that if I test positive for COVID-19 during the 14 days prior to my tour departure date, I will notify BREAK-AWAY TOURS and acknowledge that I will not be able to join the tour. I understand that standard cancellation terms will apply.

☐ I understand that I will need to comply with specific requirements imposed by airlines and/or countries. It is my responsibility to be aware of and to comply with airline carriers' and countries' requirements and present valid documentation for my flight and/or entry.

☐ I understand there may be some restaurants, museums, transportation providers, etc. that require proof of vaccine or a negative COVID-19 test before I will be allowed to enter. I understand that if I do not have the required proof, I will not be allowed entry and I will not receive a refund for any portion of the tour I miss as a result.

☐ I agree to take personal responsibility for my own health and wellbeing while on tour. If I am asked to attest to my health on tour, I will do so honestly. If I show symptoms of COVID-19 or any other contagious illness, I will notify my guide, quarantine myself, and, if requested by BREAK-AWAY TOURS, be seen by a health professional at my own expense as a condition of continuing on the tour. I understand that I will not receive a refund for any portion of the tour I miss while properly managing my health.

☐ I understand that noncompliance with the conditions listed on this COVID-19 Health and Safety Pledge by myself or those traveling with me will result in our party not being able to continue on the tour.

11 AIRFARE CONTRACT

All airlines are independent from Break-Away Tours; Break-Away Tours does not own, manage or operate any air carrier or aircraft.

Your airline ticket is a contract between you and the air carrier only, even if you purchase through Break-Away Tours. By purchasing your air services through Break-Away Tours, you waive all liability for Break-Away Tours for such air services.

Seat Assignments

Seat assignments are not guaranteed even after they are assigned, and Break-Away Tours has no control over airline seat assignments. Airlines and Break-Away Tours reserve the right to change seat assignments at any time without notice, for any reason.

Airfare Schedule Changes

Break-Away Tours is not responsible or liable for any airline cancellations, schedule changes or delays. Prior to check-in, for airfare purchased through Break-Away Tours, Break-Away Tours may be able to assist if you are rescheduled, delayed or cancelled. After you check-in, Break-Away Tours can no longer assist you and you must work with the airline directly to arrive at your destination. Break-Away Tours is not liable for expenses you incur if you miss your flight or flight connection.

Any amendments you make voluntarily to your air or air schedule may incur change fees or additional charges up to the full ticket price. These are your responsibility to pay.

Our Service may contain links to third-party websites or services that are not owned or controlled by us.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Governing Law

These Terms shall be governed and construed in accordance with the laws of California, U.S.A., without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
